Terms and Conditions

Tandem Paragliding in Zurich

GENERAL INFORMATION

The passenger expressly declares that he/she is physically and mentally healthy, has no cardiac or circulatory diseases, equilibrium disorders, neurological diseases or other, including chronic diseases, and feels able to cope with the stresses of the flight. If the passenger is unclear about his suitability for the flight, the passenger is obligated to have a medical certificate confirmed by a doctor. It is the passenger`s responsibility to cancel the flight if:
– no theoretical instruction has taken place.
– if he or she has failed to understand the briefing in whole or in part.
– if he or she is under the influence of alcohol, drugs or medication.

The passenger accepts the conditions of Zürich Paragliding by sending the booking, settling the invoice amount, verbal granting of a promotion order and / or giving a signature / redeeming of gift certificates. The costs for Photo & Video Service, transport up to the takeoff and the like, are not included in the flight fee, but you can book them additionally.

It is the passenger`s responsibility to wear suitable clothing (weather and windproof, suitable for soiling), if possible fixed shoes (reaching over the ankles) and tear-resistant gloves. The Tandempilot undertakes to provide head protection (helmet), and flight equipment. In the case of passengers under 18 years, the signatures of both parents / legal representative(s) are required.

It is the passenger`s responsibility to follow the instructions of the pilot unconditionally and immediately. This serves his / her own security. In particular, not following the briefing and the instructions during take-off, flight and landing, may result in injury to the passenger and the pilot. If the instructions of the pilot are not followed, the pilot can disqualify the passenger from the flight operation. In the case of an offense, the claim for a refund will be refused. The passenger is liable for damage to persons due to failure to follow instructions from the pilot. The passenger is liable for intentional or grossly negligent damage to equipment, pilots or third parties caused by the passenger.

PAYMENT

It is the passenger`s responsibility to pay by means of an oral commitment or booking via the website. The flight fee and ordered options are payable without deduction. When booking a passenger flight (by order or verbal) the fee is payable immediately after the booking by transfer. For short-term bookings it is possible to pay the fee in cash after the flight.

The booking is confirmed by Zürich Paragliding in writing, by telephone or by e-mail. When a gift certificate is booked, it is immediately sent to the customer. In the case of a failure to show up at the meeting point on fixed dates, the entire fee is still required. Gift certificates expire 24 months after the date of issue. Claims for an extension of the period of a gift certificate by the participant are no longer valid after 2 years.

CANCELLATION BY THE PASSANGER

You have the right to revoke your contract within 14 days after receiving the gift certificate without giving reasons in text form (eg.: letter, e-mail) or by returning the gift certificate. A subsequent revocation is not possible. The timely sending of the revocation or of the gift certificate is sufficient to ensure the revocation period. You have to bear the cost of returning. The right of revocation does not exist if the gift certificate has already been redeemed.

A transfer of paid services to another beneficiary is possible at the same time.

There is no claim for damages, reimbursement of flight fee or reimbursement of any expenses incurred in case of delay or delayed delivery.

Flight bookings and reservations are binding and can only be canceled up to 24h before the scheduled date. If the passenger does not appear at the agreed date without notification to the pilot (or Zürich Paragliding), or appears under the influence of alcohol or drugs, the passenger will be charged CHF 200 as a compensation.

If the participant breaks off the activity or leaves it prematurely, no refund will be given. Any additional costs will be the responsibility of the participant.

AGREED DATES / WEATHER

Paragliding flights are dependent on the weather. On the evening before the flight day, the passengers must call Zürich Paragliding +41774702274 between 18:00 and 20:00 to find out the exact meeting point. If the weather is not flyable, the flight has to be postponed.

We expressly point out that there is no entitlement to fly, even if the dates are fixed, if weather conditions do not allow this. There is no claim for damages, reimbursement of flight fee or reimbursement of any expenses incurred in case of delayed or delayed delivery. However, the claim for the reconnaissance of the flight remains.

The flying site is determined depending on the weather by Zürich Paragliding or the Tandempilot. The details of the flight are determined by the pilot. The duration of the passenger flight depends on the weather conditions. The pilot is always responsible for carrying out the flight. The pilot is entitled to cancel the flight if he considers the passenger unsuitable or if he considers the external conditions (weather, wind, terrain, material) to be unsuitable. The passenger confirms that his / her participation is of personal interest, to familiarize him/herself with the sport of paragliding.

LIABILITY AND INSURANCE

Paragliding is considered to be a non-risk sport in Switzerland, but an accident (eg: stumbling when starting) is not completely excluded. The accident insurance is the responsibility of the participant. With the accident insurance compulsory for Swiss workers one gets through well. If you do not have insurance, we can offer you additional insurance for CHF 20. This must be communicated as soon as possible, at the latest while fixing the date for the flight.

The passenger flies at his/her own risk.

In the context of our tandem flight performance, we are only liable for damages caused by gross negligence and / or intent. As far as legally permissible, the passengers release the tandem pilot(s) from any liability, which goes beyond existing insurance.

The liability insurance of our pilots covers CHF 5 million.

If Zürich Paragliding transfers the execution to a partner company, he is not liable for the partner`s actions and omissions. In particular, Zürich Paragliding is not liable for damages resulting from acts or omissions of the pilot which are not connected with the contractually agreed service.

Zürich Paragliding is not liable for damages resulting from acts of third parties, other participants, natural events, official orders, etc., or due to delayed return. If a participant does not comply with the instructions of the organizer or pilot, etc., all liability of the organizer is ceased.

CONCLUSIONS

Should individual provisions of the General Terms and Conditions be ineffective, the effectiveness in all other points shall remain unaffected. Swiss law is exclusively applicable. Passengers from the USA or Canada expressly waive jurisdiction in the USA or Canada for any disputes arising from the passenger flight and acknowledge that neither Zurich Paragliding nor the pilot agree to jurisdiction in the USA or Canada. The parties to this agreement agree to have as the exclusive Jurisdiction Lucerne (LU).
